Proprietary Rights in Content on EventNow.TV.
1. EventNow.TV does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, or any other materials (collectively, "Content") that the Artists / Event Hosters post to the EventNow Services. After posting the Artists / Event Hosters Content to the EventNow Services, the Artists / Event Hosters continue to retain all ownership rights in such Content, and the Artists / Event Hosters continue to have the right to use the Artists / Event Hosters Content in any way the Artists / Event Hosters choose. By displaying or publishing ("posting") any Content on or through the EventNow Services, the Artists / Event Hosters grants to EventNow.TV a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the EventNow Services.
Without this license, EventNow.TV would be unable to provide the EventNow Services. For example, without the right to modify Artists / EventHosters Content, EventNow.TV would not be able to digitally compress music files that Artists / Event Hosters submit or otherwise format Content to satisfy technical requirements, and without the right to publicly perform Artists / Event Hosters Content, EventNow.TV could not allow the Site Visitors to listen to music posted by the Artists / Event Hosters.
The license the Artists / Event Hosters grant to EventNow.TV is non-exclusive (meaning the Artists / Event Hosters are free to license the Artists / Event Hosters Content to anyone else in addition to EventNow.TV), fully-paid and royalty-free (meaning that EventNow.TV is not required to pay the Artists / Event Hosters for the use on the EventNow Services of the Content that the Artists / Event Hosters post), sub licensable (so that EventNow.TV is able to use its affiliates and subcontractors such as Internet content delivery networks to provide the EventNow Services), and worldwide (because the Internet and the EventNow Services are global in reach). This license will terminate at the time the Artists / Event Hosters remove the Artists / Event Hosters Content from the EventNow Services. The license does not grant EventNow.TV the right to sell the Artists / Event Hosters Content, nor does the license grant EventNow.TV the right to distribute the Artists / Event Hosters Content outside of the EventNow Services.
2. the Artists / Event Hosters represent and warrant that: (i) the Artists / Event Hosters own the Content posted by the Artists / Event Hosters on or through the EventNow Services or otherwise have the right to grant the license set forth in this section, and (ii) the posting of the Artists / Event Hosters Content on or through the EventNow Services does not violate the privacy rights, publicity rights, intellectual property rights (including copyrights), contract rights or any other rights of any person. the Artists / Event Hosters agree to pay for all royalties, fees, and any other monies owing any person by reason of any Content posted by the Artists / Event Hosters to or through the EventNow Services.
3. The EventNow Services contains Content of EventNow.TV ("EventNow.TV Content"). EventNow.TV Content is protected by copyright, trademark, patent, trade secret and other laws, and EventNow.TV owns and retains all rights in the EventNow.TV Content and the EventNow Services. EventNow.TV hereby grants the Artists / Event Hosters a limited, revocable, non sub licensable license to reproduce and display the EventNow.TV Content (excluding any software code) solely for the Artists / Event Hosters personal use in connection with viewing the EventNow Website and using the EventNow Services.
4. The EventNow Services contains Content of Artists / Event Hosters and other EventNow.TV licensors. Except for the Content that is posted and owned by the Artists / Event Hosters themself, the Artists / Event Hosters and or Site Visitors may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content appearing on or through the EventNow Services.
Content Posted.
1. EventNow.TV may delete any Content that in the sole judgment of EventNow.TV violates this Agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any person. EventNow.TV assumes no responsibility for monitoring the EventNow Services for inappropriate Content or conduct. If at any time EventNow.TV chooses, in its sole discretion, to monitor the EventNow Services, EventNow.TV nonetheless assumes no responsibility for the Content, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the Artists / Event Hosters submitting any such Content.2. the Artists / Event Hosters are solely responsible for the Content that the Artists / Event Hosters post on or through any of the EventNow Services, and any material or information that the Artists / Event Hosters transmit to other Site Visitors and for the interactions with other Artists / Event Hosters and or Site Visitors. EventNow.TV does not endorse and has no control over the Content. Content is not necessarily reviewed by EventNow.TV prior to posting and does not necessarily reflect the opinions or policies of EventNow.TV. EventNow.TV makes no warranties, express or implied, as to the Content or to the accuracy and reliability of the Content or any material or information that you transmit to the Site Visitors and or other Artists / Event Hosters.
